‘Debt Recoveries’ can help with the issue of Court Action, by drafting all the appropriate Court Forms, and arranging for the issue of the Proceedings either for you via Solicitors, or on your behalf ourselves.

In the event a Defendant defends the Court Action, the case then becomes contested.

A Defendant may contest a case for a number of reasons, sometimes legitimately, sometimes not: They may have a genuine argument, but more often than not they may be trying to simply buy time, to put off the evil day when they have to pay.

Whatever the reason, the fact the Court case has become contested invariably makes the case more protracted and involved.

In cases where the sum involved is less than £5000 (designated small claims) the Courts can’t award legal costs to a winning party, so in these cases, ‘Debt Recoveries’ offer a pre paid fixed cost in house litigation support service for £250*. This modest sum covers all matters, from the drafting of any necessary Reply to the Defence, to completion of the allocation questionnaire, to drafting all necessary witness statements and your List of Documents. However, it should be noted that ’support’ does not mean ‘Debt Recoveries’ act for you nor that we will attend Court.

In cases where the sum involved exceeds £5000, the Courts can award costs to a winning party, so in these cases you have two choices: ‘Debt Recoveries’ still offer a pre paid fixed cost in house litigation support service, at £500* or we can introduce your case to one of our panel of external Specialist Litigation lawyers. They will act for you. They will attend Court. They normally charge by the hour. The choice will always be yours.
